The agreement

These terms are the agreement between you and Walker Innovations, LLC (“NeverBETtr”, “we”, “us”) for the NeverBETtr Android app and this website. By creating an account, starting a subscription or accepting an invitation to be an accountability partner, you agree to them. Our privacy policy explains what we collect and who sees it.

Who can use NeverBETtr

• You must be 18 or older and in the United States.
• You may install the app only on a phone that is yours, to monitor yourself. NeverBETtr is not for monitoring another person, and it may not be installed on someone else’s phone without their knowledge.
• One account per person. Keep your sign-in details to yourself.

What NeverBETtr does

While monitoring is on, the app checks the sites your phone looks up against a list of gambling sites, and checks for gambling apps. When it finds gambling activity, your accountability partners are notified automatically. NeverBETtr is designed to notify them as well when monitoring is turned off, uninstalled or tampered with.

• NeverBETtr doesn’t block anything. Every site and app still works.
• Our lists are large and updated regularly, but no list is complete, and we don’t promise that every gambling site, app or workaround will be detected.
• A report means your phone looked up a gambling site or has a gambling app. It is not proof that a bet was placed.
• NeverBETtr is an accountability tool. It is not medical care, counseling or treatment. If gambling is causing harm, the National Problem Gambling Helpline is free, confidential and available 24/7 at 1-800-MY-RESET.

Your accountability partners

• You choose who to invite. Invite only people you know, who are 18 or older, and who you believe are willing to be asked.
• Until a partner accepts, all they receive is the invitation, which shows your name and says you are using NeverBETtr to stop gambling.
• A partner’s name and email address can’t be changed once they are invited. To change them, remove the partner and invite them again.
• Inviting or removing a partner notifies your other partners. Turning monitoring off, canceling, missing a payment and deleting your account notify every partner who has accepted.
• Only a partner can mute a site or an app. You can’t mute one yourself.

If you are an accountability partner

You need no account and you install nothing. What you receive is personal and was shared with you in trust. Use it only to support the person who invited you, and don’t pass it on. You can decline an invitation, and you can stop at any time by writing to support@neverbettr.com. The links in our emails open your dashboard without a password, so don’t forward those emails.

Subscription, free trial and canceling

• NeverBETtr costs $9.99 a month or $49.99 a year. You choose a plan on this website and enter a card on Stripe’s checkout page.
• First-time members get a 3-day free trial that starts at checkout. If you don’t cancel before it ends, your plan starts and your card is charged.
• Your subscription renews automatically every month or every year, at the price of your plan, until you cancel.
• You can cancel at any time. On your account page, choose “Manage billing”, which opens Stripe’s billing page, and cancel there. Your subscription then does not renew. Cancel during the free trial and you are not charged.
• 30-day money-back guarantee. If NeverBETtr isn’t helping, write to support@neverbettr.com within 30 days of your first payment. We refund everything you have paid and end your subscription. The guarantee covers your first subscription.
• After those 30 days we don’t refund a period that has already started, unless the law requires it. If you were charged by mistake, write to us and we will put it right.
• If a payment fails, we try again for a short time. If it still fails, your subscription ends and monitoring stops.
• If we change the price, we will tell you by email before your next renewal, and you can cancel before the new price applies.
• Deleting your account cancels your subscription immediately.

Using NeverBETtr fairly

You agree not to:

• use NeverBETtr to watch, track or harass another person;
• invite someone as a partner in order to send them unwanted email;
• interfere with the service, probe it for weaknesses or try to reach other people’s data;
• copy, resell or reverse engineer the app or this website.

We may suspend or close an account that breaks these terms. If we close your account for a reason other than a breach, we will refund the unused part of what you paid.

No guarantees

NeverBETtr is provided as it is. We work to keep it running and accurate, but we don’t promise that it will be uninterrupted or error-free, that every alert will be delivered or read, or that it will detect all gambling activity. Phone makers, Android updates and network settings can stop monitoring from working, and NeverBETtr is designed to report that when it happens. Decisions about gambling, and about how to respond to an alert, remain yours and your partner’s. The 30-day money-back guarantee is a promise about refunds, not about results.

Limit of our liability

To the extent the law allows, NeverBETtr and Walker Innovations, LLC are not liable for indirect or consequential losses, including gambling losses, and our total liability to you for anything connected with the service is limited to the amount you paid us in the 12 months before the claim. Some states don’t allow these limits, so they may not apply to you.

Ending the agreement

You can stop using NeverBETtr at any time by deleting your account, in the app or from your account page (how to delete). That cancels your subscription, and your partners are notified. The sections on liability and governing law continue to apply afterwards.

Governing law

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules.

Changes to these terms

When these terms change we will post the new version here and change the date at the top. If a change affects what you pay or what your partners see, we will tell members by email before it takes effect.
